CONCERNING
AMENDMENT TO THE DECREE OF THE MINISTER OF FINANCE NO.291/KMK.05/1997 ON BONDED WAREHOUSES AS ALREADY AMENDED THE LATEST BY THE DECREE OF THE MINISTER OF FINANCE NO.292/KMK.01/1998

THE MINISTER OF FINANCE

Considering :

• a. that the use of goods resulting from the processing activities in bonded zones as the support of industries in other Indonesian customs areas needs to be further increased;
• b. that exports by companies located outside bonded zones, which produce export commodities need to be increased;
• c. that in relation thereto, it is deemed necessary to re-stipulate the total of release of products processed by PDKB which produce finished goods or other goods/materials for further processing in other Indonesian customs areas, by issuing a decree of the Minister of Finance;

In view of :

• 1 . Law No.10/1995 on customs affairs (Statute Book of 1995 No.75, Supplement to Statute Book No.3612);
• 2. Government Regulation No.33/1996 on bonded stockpiling sites (Statute Book of 1996 No.50, Supplement to Statute Book No.3638) as already amended by Government Regulation No.43/1997 (Statute Book of 1997 No.40), Supplement to Statute Book No.3717);
• 3. Presidential Decree No.122/M/1998;
• 4. Decree of the Minister of Finance No.291/KMK.05/1997 on bonded warehouses as already amended the latest by the Decree of the Minister of Finance No.292/KMK.01/1998;

DECIDES :

To stipulate :

THE DECREE OF THE MINISTER OF FINANCE CONCERNING AMENDMENT TO THE DECREE OF THE MUSTER OF FINANCE NO.291/KMK.05/1997 ON BONDED WAREHOUSES AS ALREADY AMENDED THE LATEST BY THE DECREE OF THE MINISTER OF FINANCE NO.292/KMK.01/1998.

Article 1

To amend Article 10 paragraph (7) of the Decree of the Minister of Finance No.291/KMK.05/1997, so as to read as follows :

"Article 10

(7) The release of goods already processed by PDKB which are destined for DPIL, can be done by using Import Declarations (PIB/BC.2.0) in accordance with the customs procedure in the import sector, with the provision as follows :

a. The release to DPIL by companies using Bapeksta Keuangan a facility is treated the same as the release for export purposes.

b. The total of release to PDIL, after the realization of export and/or release to other PDKB is as follows :

b.1. goods which need not further processing, can function independently without the support of other goods and are used by end consumers is at the maximum 50%;

b.2. goods other than those as meant in letter b.1 is 100%; of the value of exports realized and/or release to other PDKB."

Article 2

This decree shall come into force as from July 1, 1999.

For public cognizance, this decree shall be published by placing it in State Gazette of the Republic of Indonesia.
